Current Court Report – December 1

This week’s Current Court Report includes cases from Monday’s Nantucket District Court session.

A Feb. 28, charge of assault and battery will be continued without a finding for six months against Jethro Allerhand, 28, of Nantucket. He was ordered to pay a $50 victim-witness fee and $50 per month in probation fees. A second charge of assault and battery stemming from the same incident was dismissed.

Nov. 13 charges of operating a motor vehicle under the influence of alcohol and resisting arrest will be continued without a finding for one year against Collin Byrnes, 33, of Nantucket. He was ordered to forfeit his license for 45 days, complete a driver alcohol education program, pay a $250 program fee, $250 head-injury fee, $50 OUI fee, $50 victim-witness fee, and $65 per month in probation fees.

Katherine E. Culhane, 46, of Nantucket, pleaded guilty to a Sept. 1 charge of operating a motor vehicle under the influence of alcohol (second offense). She was ordered to forfeit her license for 45 days, complete a driver alcohol education program, pay a $250 program fee, $250 head-injury fee, $50 OUI fee, $50 victim-witness fee, and $65 per month in probation fees.

A 2015 admission to a Sept. 10, 2014 charge of operating a motor vehicle under the influence of alcohol was converted to a continued without a finding disposition on a charge of negligent operation of a motor vehicle stemming from the same incident against Jeffrey Hodge, 57, of Warwick, RI, after Judge Thomas S. Barrett allowed a motion for a new trial based on the fact that the breathalyzer test had to be discarded due to issues with its accuracy. The defendant said he would not have pled out five years ago if the test were not admissible. He completed his original probation in 2016, therefore he will not have to complete another year of probation and the charge was dismissed.

A July 23 charge of operating a motor vehicle under the influence of alcohol will be continued without a finding for one year against Noah Kaplan, 20, of New York. He was ordered to forfeit his license for 210 days, complete a driver alcohol education program, undergo an alcohol assessment, pay a $250 program fee, $250 head-injury fee, $50 OUI fee, $50 victim-witness fee, and $65 per month in probation fees.
